strength over the atlantic. winds at 58 miles per hour gusting to 69 miles per hour and the track of the storm is going to be taking it off the coast of the united states. looks like it's making land fall up to nova scotia, canada but for us over the weekend towards saturday then sunday we are watching this closely because the storm could become category 1 strength by the time it reaches off the coast line of the del mar but areas along the coast will be getting republic current and some gusty winds and we could even see wrap around storms from this as we get through late friday night and saturday. how this is affecting the weekend plans out here at the state fairgrounds coming up in just a bit. thanks so much. you can track danny with fox 45 sky watch hurricane tracker available at fox baltimore.co baltimore.com. fox 45 doppler radar to track coming storms. go to our web site and click on hurricane tracker. in other news. state correctional officer is murdered in east baltimore at 6:00 a.m. police discovered 37-year-old eric car shot

three times in a ford explorer in the 1400 block of ken hell avenue. >> officers called to the area for shots fired. they did a canvas. and this car was found in a vehicle unresponsive in a ford explorer. >>reporter: police have no suspect nor a motive. shooting in west baltimore leaves one man shot and happened just after 2 this afternoon at preston and free month. no word on the conditions of the victim there. shots ring out after routine traffic stop in the 6000 block of silver bell road. it happened last night. police say the driver backed up trying to run them down. cops then open fire and driver took off. minutes later the automobile was found along arizona avenue. the driver got away but the female passenger was shot. she is expected to fully recover. plea deal apparently being worked out in the case of a 17-year-old charged with killing her grandmother. arrested last november. today it appeared an agreement was

worked out but a judge then denied it. and he could be convicted as an adult. >> perhaps the family has asked the state attorney office for instance maybe that look we don't want this young lady to be in prison in the adult system so this is a case that the state would probably like to resolve expeditiously and as quickly as possible. >> now the judge rejected the plea deal citing the age. video that shows the horrific reality of texting while driving is an on line smash hit. karen parks joins us with whether video is just too realistic. karen? >> the video is proud but depicts a real truth. we must warn you the video can be quite disturbing to some. texting while driving. turns deadly in this police proud video seen on you tube. that sends a gruesome message.

truth too difficult for her to swallow. >> i couldn't watch the video. >>reporter: 26-year-old daughter was killed last year in davenport, florida by a trucker texting. the trucker crashed into 9 cars killing 2 people including heather. >> unfortunately i did read my daughter's autopsy and i know what happened to her. i couldn't see it by watching the video. >>reporter: he says this video might be harsh but needs to be seen. >> especially for young people because they think that they are immune to this. >>reporter: national highway traffic safety administration says almost 50% of all drivers between 18 and 24 are texting while driving. and adult drivers detective behind the wheel. >> serious probable. only takes 7 eighth of a second to be killed in a car crash. >> 7 states have banned text messaging including washington, d.c. maryland

also tried to break into a locked window. now the pastor says all of this happened after the church agreed to have 21-year-old david's funeral here at the church. he was shot and killed over the weekend and tonight the pastor believes the people responsible for that deadly shooting are now sending a message. >> we not only know where the funeral is being held, but we have come in and we have desecrated the place where it is going to be held. that is their way of striking fear in the hearts of people who do not have faith. i do not believe that anything will happen to me. i do not believe anything will happen to anybody who comes here. >>reporter: police say he has an extensive criminal record that includes aggravated assault and several narcotics charges. he was known on the street as daner. investigators trying to determine now if he has any connection to any gang. mean

time the pastor says this funeral will go on. tomorrow morning at 10:00 o'clock. live now in south west baltimore, fox 45 news at 5:30. the cash for clunker program appeared to be a major success. but now some car dealerships are complaining uncle sam isn't paying up. kathleen live at the ma bell ford dealership with the latest on the story. quite interesting kathleen. >>reporter: well, jeff, at this dealership alone 208 new cars were sold through the cash for clunker program. now all the clunkers are sitting right here in the back parking lot. one of them is this jeep. the problem is? the dealership has only been reimbursed for one of the cars so far. it could take up to 6 months to get the money. check this out. this was one of the clunker that was turned in. it has 200,000 miles on it. it's a stick shift. take me a little. >> if it looks like everything

is right without the little nitpicker of maybe the driver license is a little too dark, you know, pay us the money and make us provide the documentation on the back up. that way we can get our money and we'll be more than happy to get whatever is needed. >>reporter: as you can see clunker like this don't even start um this one has 200,000 miles. burns a lot of gas. and oil. so that was a good thing to get it off the road. however, the dealership says that the problem is they are not being reem bursted for so many of the other cars. they have gotten one check from uncle sam so far and they say it could take 6 months to get the rest of the money. so in the mean time this dealership alone is holding the tab for 400,000 dollars. more on that story tonight at 10:00. fox 45 news at 5:30. like the jeep thanks so much. how are the roads out there tonight? kandace has our traffic edge report. kandace?

>>reporter: thank you jeff. we have some big time trouble in andarundle county tonight. there is an accident on the northbound lanes of 97. right at the exit from westbound route 50 but look at all of those cars not even moving there from 50 on to 97. so that is going to be the big issue for us but if you are traveling on 97 through andarundle county heading up near the glen byrne area might see the drive up to the belt way. crash on outer loop lanes of the belt way washington at could he have road that cleared out and disabled vehicle on the northbound lanes of 95 at the fort mchenry tunnel. 8 95 is going to be the best bet for the alternate routes. of course we still are dealing with the gas main leak today. utah street blocked at baltimore street and fay street continuing to be blocked at utah. that's the evening travels. now back to you. >> all right thanks so much. >> still ahead at 5:30. very beginning of three days of tribute and celebration on the life of senator ted kennedy. >> ♪ boys to men is back.

>> memorial for the late massachusetts u.s. senator ted kennedy going on all day today as you may very well expect. kate is in boston with more including the task of filling senator kennedy's senate seat. >> farewell to his beloved family compound. the beginning of a final journey. onlooker gather to watch the motorcade carrying the late senator ked kennedy from hyannis port to boston and public will pay final respect to the legislator and the man. >> people liked him. he had sympathy for people that were in polite or in disadvantaged. it came through in his entire career. >>reporter: but as massachusetts mourns the loss of their long time legislator,

questions remain about who will take his seat. it is something kennedy thought about in his final days when he asked democratic governor patrick to find a way to ensure that successor would be chosen sooner rather than later. >> he also made reason request that the governor be permitted to appoint someone to serve for the 5 month period until special election occurs. as i say i think that is imminently reason. >>reporter: for the kennedy f family, the loss even more profound as they gather to mourn their patriarch. >> nobody who is strong enough and who has the backing of all the members of the family or who can impose his will on the family total take the place of tedy. so for quite some time, i think, we are going to see a vacuum in that role. >>reporter: now before senator kennedy reaches his final resting place at arlington national cemetery thousands are expected here to pay train out and a private funeral mass is planned for

perfect day to kick off the 128 maryland state fair. vytas live at the fair wearing a don oh, shirt. will the weather hold for the fair goers, tonight. >> you know, it is ify because we have a chance of cloudy showers here and there. we are not going to worry about that. this is ride mania tonight. it's the beginning of ride mania from 6:00 o'clock until 9:00 o'clock. only 15 dollars come out here and ride all the rides, ride them all again and justin to have a party time out here because this is good night to get out here. there is a threat for pop up shower or thunderstorm. in fact let's go right to radar here. there is a little thunderstorm over towards rice town and will continue to make its way down into baltimore city, baltimore county. we watch that very closely as the one cell, one annoying cell manufactures through but it's brief. rain for a minute and clear out then once again the party begins out here at maryland

door. >> don't put that camera in my face. get outside. e-the crew was at the home to ask relatives apparently about the arrest of 2 teenagers. woman chased them off the property with a garden hoe. as you saw saw, actually hit the television camera with the photographer. wow! new study shows playing in the sand actually could give you e.coli bacteria infection. doctors say there's more e.coli bacteria in beach sand than in the water. all the beach in the study had sewage treatment facilities within 7 miles but they all had acceptable water quality levels. >> .
